1. Introduction

By visiting, browsing, and using PrimaX, you agree to the terms and conditions of our Privacy Policy (“Privacy Policy”), and we kindly ask you to review it carefully.

This Privacy Policy (hereinafter referred to as the “Policy”) applies to the trading platform (including any applicable mobile applications, websites, and any extensions thereof, such as APIs used to access them) (collectively referred to as the “Platform”), provided by PrimaX (hereinafter referred to as the “Company,” “we,” “us,” or “our”).

This Privacy Policy explains how the Company collects, uses, and discloses personal information obtained from users of the Platform and any accounts provided through the Platform, and how we use and disclose such information. For the purposes of this Policy, “personal information” means information provided by a user that can directly or indirectly identify such user.

In the course of providing our services, we are required to collect and store your personal data to comply with the laws of the jurisdictions in which we operate and to improve our services. As a general rule, we never disclose any personal information of our clients to third parties that are not our partners, except as described below.

Information We Collect Automatically

Cookies are alphanumeric identifiers that we transfer to your computer’s hard drive through your web browser for record-keeping purposes. Some cookies make it easier for you to navigate our Platform, while others are used to speed up the login process or to track your activities on our Platform. We may use the following cookies:

Geolocation: If you grant permission through your mobile device to allow us to collect location data via our mobile application, we may obtain information about your physical location (latitude and longitude) using technologies such as GPS, Wi-Fi, or cell tower proximity. You may withdraw your consent to our collection of such location information via your device settings, although we do not control this process. If you have questions about disabling your mobile device’s location services, we recommend contacting your mobile service provider or device manufacturer.

  • If we believe the disclosure is necessary to comply with our Terms of Service;
  • To comply with requests from government authorities worldwide, including regulators, law enforcement agencies, and/or ministries of justice;
  • When PrimaX is required to do so due to a subpoena, court order, government request, or similar legal process in any applicable jurisdiction, initiated by governmental authorities or other parties to legal proceedings;
  • To comply with any applicable laws and regulations in any relevant jurisdictions;
  • To our service providers (including, without limitation, payment processing partners, banking partners, data storage providers, CRM solutions) and other third parties that assist us in providing you with Services and/or as required or permitted by law or professional standards, including, for example, fiat gateways, customer support, data analytics, information technology, data processing, network infrastructure, storage, and tax reporting;
  • To members of our corporate group, which includes our subsidiaries, holding companies, and entities under common control, including their respective contractors, partners, employees, or representatives;
  • To legal entities in connection with corporate transactions involving PrimaX, including any financing, acquisition, or liquidation proceedings that may involve the disclosure of certain parts or all of our business or assets;
  • To professional advisors, including legal, accounting, or other consulting services, for audit purposes or to fulfill our legal obligations; and/or
  • In connection with the sale or transfer of our business or any part thereof.

Furthermore, we have implemented international standards for combating money laundering, terrorist financing, and the circumvention of trade and economic sanctions, and we will implement applicable digital asset laws and regulations in all relevant jurisdictions once they come into force. This may require us to conduct customer due diligence, which may include the use of third-party data and service providers whose information we may cross-check against your personal information.

5. Security of Your Personal Information

We have taken reasonable precautions, in accordance with applicable laws and regulations, to protect the personal information we collect from loss, misuse, and unauthorized access, disclosure, alteration, and destruction. Please note that despite our efforts, no data protection measures can guarantee 100% security. Therefore, all users (including their authorized representatives) of the Platform must comply with the security requirements outlined in the Terms and take the following additional steps to help safeguard their personal information and account access:

  • You should choose a strong user identification, password, and PIN for accessing your account (“User Credentials”), which no one else knows or can easily guess. User Credentials must comply with the requirements we specify when you create them. You must keep your User Credentials secure and confidential and never share them with third parties.
  • You should install antivirus and anti-spyware software and a firewall on your personal computers and mobile devices.
  • You should regularly update operating systems, antivirus programs, and firewalls with security patches or newer versions.
  • You should disable file and printer sharing on your computers, especially if they are connected to the Internet.
  • You should regularly back up your important data.
  • You should consider using encryption technology to protect highly sensitive or confidential information.
  • You should always log out completely and clear your browser cache after each online session on the Platform.
  • You should not install software or run programs from unknown sources.
  • You should delete unwanted or chain emails.
  • You should not open email attachments from unknown senders.
  • You should not disclose personal, financial, or credit card information to little-known or suspicious websites.
  • You should not use computers or devices that cannot be trusted.
  • You should avoid using public computers or internet cafés to access online services or conduct financial transactions.

You must notify us immediately via the provided form if you become aware of any unauthorized use of, or access to, your account or User Credentials. We are not responsible for any lost, stolen, or compromised User Credentials, or for any actions taken in your account as a result of unauthorized use of your User Credentials.

6. Rights of Access, Correction, and Deletion

You may access, edit, update, or delete your account or personal information that we have collected at any time by logging into your account settings or contacting us. We will respond to your requests within a reasonable timeframe, but no later than the period required by law.

Please note that, notwithstanding the foregoing, there may be circumstances in which we are unable to fulfill a request to edit, update, access, or delete your account profile or personal information. This includes, but is not limited to:

  • Any reason for which such a request may be denied under applicable law;
  • When we are required to retain the information under federal law or for accounting or tax purposes;
  • When we are required to comply with a civil, criminal, or regulatory request, investigation, subpoena, or summons by federal, state, or local authorities;
  • When we are required to cooperate with law enforcement regarding conduct or activity that, in the reasonable and good faith judgment of the company, service provider, or a third party, may violate federal, state, or local law;

If we determine that we are unable to comply with any request in a particular instance, we will provide you with an explanation as to why such a decision was made and the contact information for further inquiries. To protect your privacy, we will take commercially reasonable steps to verify your identity before responding to any request under this provision, including compliance with any applicable legal requirements for identity verification.

7. Data Transfer

Please note that we may store your personal information on servers located in countries where our headquarters are based. If such jurisdiction is outside of your country of residence, you consent to the transfer of your personal information to such jurisdiction for the purpose of providing you with the Platform, even if that jurisdiction provides less protection for personal information than your country of residence. We will ensure that security provisions are in place to meet our obligations to safeguard your personal information in accordance with the laws of your country of residence.

8. Data Retention

We retain your personal information for as long as you maintain an account on the Platform. We will cease storing your personal information or remove the means by which personal information can be associated with identifiable individuals once it is reasonably determined that its retention no longer serves the purpose for which it was collected, and its retention is no longer necessary for legal, accounting, or business purposes.

Please note that certain laws may require us to retain records of transactions or accounts for a specified period of time.

9. Children Under 18

Our Platform is not intended for children under the age of 18. If we become aware that a child under 18 has provided us with personal information, we will delete such information from our systems.
