Trump considers keeping multibillion-dollar illegal tariffs

One idea is to declare the legality of the payment of customs duties collected over the past year, in accordance with the updated set of duties.

Officials in the Trump administration are hastily devising legal strategies that would allow the government to keep billions of dollars in customs revenue that the Supreme Court says was illegally collected.

Initial ideas include measures to discourage companies from seeking refunds, prevent government refunds or otherwise preserve at least some of the revenue from customs duties, according to five people familiar with the discussions who wished to remain anonymous.

One idea, the two sources said, is to make a case for the legality of paying customs duties collected over the past year under an updated set of duties that the administration is now developing based on different legal norms.

Another idea would allow companies to bypass an expected long refund queue if they agree to hand over some of the money to the state, according to one source familiar with the situation.
